General terms and conditions
1. Definitions
1.1 Helena Vegter (‘’Wilhelmina Helena’’, ‘’us’’, ‘’we’’ and ‘’our’’). Wilhelmina Helena is an individual entrepreneurship. Therefore this website and all its communication is managed by Wilhelmina Helena. We are registered at the Chamber of Commerce under number 71063471. 1.2 ‘’Wilhelmina Helena’’ identifies shopping platform wilhelminahelena.com/shop and the entity behind it. Wilhelmina Helena offers merchandise created around the artistry of Helena Vegter. ‘’Customer’’ means the entity purchasing products from Wilhelmina Helena. ‘’Agreement’’ identifies the contract that is formed between customer and Wilhelmina Helena. When you place an order, you agree to our terms and conditions, and a contract is formed between customer and Wilhelmina Helena. Also, when visiting our website, you agree to our terms and conditions. ‘’Product’’ refers to the products, merchandise and other items that are displayed in our webshop.
2. Applicability

2.2 Please read these terms and conditions carefully before accessing or using our website and webshop. By accessing it, you agree to be bound by these terms and conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any of our services.
2.3 These terms and conditions supersede all previous representations, understandings or agreements provided by Wilhelmina Helena.
2.4 Wilhelmina Helena reserves the right to accept or deny your offer for any reason at any time.
3. Product availability and description
3.1 We try to be as specific as possible on our webshop about the product description, information, availability, size, and colour. However, because the colours of the products you will see on the website depend on your monitor/screen, we cannot guarantee that the display of colour will be accurate and some colours may vary. If you have ordered a product that is unavailable, we will inform you as soon as possible by email and give you an estimated date of when the product is due to be back in stock and available for dispatch to you (Please note – some items may return in stock and dates are subject to change). Alternatively, you will be entitled to cancel your order and receive a refund from us (if your account has already been charged). Please note that the information provided about products on the (desktop or mobile) website is for information purposes only. Please make sure you read all labels, warnings and directions provided by the product before use.
3.2 Wilhelmina Helena creates unique products around the artistry of Helena Vegter. Please note products can have a limited stock.
4. Product copyright
4.1 Wilhelmina Helena retains the copyright and trademark of our unique products at all times.
4.2 Reselling our products for amounts double the original retail price and more is never allowed.
4.3 Commercial reselling of our products is never allowed without permission from Wilhelmina Helena.
4.4 For unlicensed use of our products Wilhelmina Helena will charge a compensation in the amount of what we consider appropriate.
5. Prices
5.1 The prices of the articles mentioned on the product page include VAT on orders within the Netherlands. Prices of our products may change from time to time, but changes will not affect any order you have already placed. Non-European orders may vary in VAT. Furthermore, for orders outside of The Netherlands, additional customs and import charges may apply. We cannot guarantee the amount of additional customs and import charges that may apply on your order outside of The Netherlands.
5.2 The price of a product does not include delivery charges. Before closing the agreement, the total price including the shipping costs is announced through our website. The amount of shipping costs will vary depending on your location.
6. Payment
Payments can be done using the payment service we provide (Ideal). After placing an order, the customer will receive an order confirmation by email.
7. Delivery
7.1 We strive to offer your order for dispatch within 3 business days after receiving your payment. Wilhelmina Helena is however not obliged to do so. Customers will be updated about order confirmation and delivery through email.
7.2 Ownership and risk in the products you have ordered will pass to you from the time they are delivered to you.
8. Return policy
8.1 Within 14 days, orders may be returned and we will issue a refund.
8.2 Sale items and custom items (this applies to signed items as well) cannot be returned.
8.3 Items must be unused, unwashed and unworn.
8.4 Items should have their original tags on and, if applicable, their undamaged packaging.
8.5 Returns can be send to Ommelanderwijk 150, 9644TP Veendam, Nederland. Please send your name and address with your return.
8.5 After we processed your return, we will send you a confirmation email. Refunds are issued within 7 business days after receiving your return. Refunds are given through bank transfer or your original form of payment.
8.6 Shipping costs are non-refundable. We don’t cover shipping costs for your returns.
8.7 If your product is damaged, contact us at contact@wilhelminahelena.com. We will assess your case and offer an exchange if applicable.
9. Complaints
9.1 We strive to deliver a good product. Please always contact us if something is wrong with your order.
9.2 Please send your complaints within 14 days after receiving your order.
10. Errors and disclaimer
10.1 We reserve the right to correct any errors or misinformations on our website and webshop at any time.
10.2 We reserve the right to cancel orders if any information in the terms and conditions or on our webshop is inaccurate without prior notice (also when you have already placed your order).
10.3 We do not guarantee that your use of our website and webshop will be secure or error-free.
11. Linking to this website and webshop
11.1 You may link to our website and webshop, but only in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
11.2 Our website and webshop including its content and products, is our copyright. Our content and products must not be displayed on any other website without our permission. We reserve the right to withdraw linking permission without notice.
12. Variation
Wilhelmina Helena shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the products and/or any page of the website and webshop.
13. Force of the majority
In case of force of the majority, Wilhelmina Helena has the right to, on our own discretion, postpone a customer’s order or to cancel the agreement without judicial intervention, by informing the customer in writing and without the obligation for Wilhelmina Helena to pay any compensation, unless this, in the given circumstances and to standards of reasonableness and fairness, should be unacceptable.
14. Governing law and jurisdiction
14.1 All cases in which these terms and conditions apply are governed by Dutch law.
14.2 Any dispute with regard to the text and explanation of these general terms and conditions will be submitted to the judge of the District Court of Groningen.

15. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
16. Termination
16.1 All liability and obligation that applies before the agreement is terminated, applies according to the guidelines of these terms and conditions.
16.2 These terms and conditions are valid unless and until terminated by Wilhelmina Helena or you.
17. Entire agreement
The above terms and conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Wilhelmina Helena. Any waiver of any provision of the terms and conditions will be effective only if in writing and signed by Wilhelmina Helena.
18. Modifications
Wilhelmina Helena reserves the right to occasionally make changes to these terms and conditions. We will post the updated terms and conditions on our website, and thus we encourage you to review this page from time to time.
